(“Vimeo OTT,” “we,” or “us”), uses cookies and similar tracking technologies on Vimeo OTT embeddable video players and the websites and applications (“apps”) it hosts on behalf of its content sellers (“Producers”). By using any of these services, you agree to the placement and use of cookies and similar technologies on your device. This Cookie Policy forms part of the Vimeo OTT Privacy Policy
Cookie Basics
A cookie is a small text file that is stored in your web browser that allows Vimeo or a third party to recognize you using a unique identifier.
Who sets them: First-party cookies are set by Vimeo OTT. Third-party cookies are set by companies other than Vimeo OTT, such as analytics providers and advertisers.
What they do: “Essential” cookies enable services we offer. “Non-essential” cookies help us understand how our services are being used (i.e., analytics) and deliver advertisements. Some cookies may track you across multiple websites you visit (including ones not operated by us) to help deliver advertisements that may be relevant to you.
How long they last: Cookies may be either “session” or “persistent.” A session cookie expires (i.e., is deleted) when you close your browser. A persistent cookie remains until it expires or you delete the cookies via your browser settings. Cookies Found on Vimeo OTT Services
We use all types of cookies in our web-based services. Our websites include https://vimeo.com/ott/ and the sites that we host on behalf of Producers (“Producer Sites”).
Producer Sites: When you visit a Producer Site, Vimeo OTT and third parties authorized by Vimeo OTT, the Producer, or both, will set cookies in your browser. Vimeo OTT sets first-party, essential cookies to enable certain features and remember your preferences. For example, cookies keep you logged in, allow you to purchase items, and maintain your language and volume settings. Third parties set cookies for both essential and non-essential purposes including analytics (e.g., Google Analytics) and advertising (e.g., Google DoubleClick for Publishers). Third-party cookies may differ among Producer Sites depending on a number of factors, including whether the Producer has enabled advertising, and which analytics providers are being utilized.
Producer Apps: Producer apps do not use cookies, but may use tracking technologies to, for example, authenticate you as a registered user, allow you to use the app’s features, and help the Producer understand how the app is being used. You cannot opt out of these mobile tracking technologies, but you may delete the app and use the web version instead.
Vimeo OTT video player: Vimeo OTT’s embeddable video player uses first-party cookies that we consider essential to the video player experience. Please note that a third-party website may place cookies of its own. We have no control over third-party websites or the cookies they set.

Similar Technologies

Darbar Player Privacy Policy
This is the Privacy Policy of Darbar Arts Culture and Heritage Trust (hereafter referred to as “us” or “we”). This Privacy Policy describes how your personal information is collected, used, and shared when you use our streaming service, Darbar Player through our website www.darbar.org or any of our branded apps (together, the “Service”).
By using the Service, you agree to the collection, use and disclosure of your information as described in this Privacy Policy. We may modify this Privacy Policy from time to time. Your continued use of the Service constitutes your agreement to any updated Privacy Policy on a prospective basis.
PERSONAL INFORMATION WE COLLECT
When you use the Service, we collect the following types of personal information:
Account Registration Information
In order to sign up for a free trial or make a purchase, you must create an account by providing us with your email address and a password. You may also create a username and upload an avatar to use for comments or forums.
Payment Information
You must also provide valid payment card information if you wish to sign up for a free trial, subscription, or make any other purchase. Except for the name associated with your card and information about the transaction (e.g., time of transaction, amount), payment card information is collected directly by a third-party payment vendor and is not received or stored by us.
Information Collected Automatically
Each time you visit the Service, we automatically collect certain information about your device and your interaction with the Service. This may include your viewing activity, your IP address, location information, your browser type, your Internet service provider (ISP), referring/exit pages, your operating system, date/time stamps, and related metadata.
Comments
We may offer the ability to provide comments or to post messages in a forum. Any posts you make will be publicly available.

Legal Situations
We may disclose your information when we have a good faith belief that compliance is required by a search warrant, subpoena, court order, or similar request from a law enforcement or other government agency.
To the Public
We may publicly disclose aggregated user statistics and other information, which is not considered personal information. If you comment on a video or participate in a forum, your comment will be shared publicly.
TARGETED ADVERTISING
We may use your personal information to provide you with targeted advertisements or marketing communications we believe may be of interest to you.
You can limit the use of your information for purposes of targeted advertising using a number of methods:

- Via AppChoices mobile app, available at https://www.youradchoices.com/appchoices, which lets you opt-out of interest-based ads in mobile apps.

The options described above must be set on each of your devices in order to apply. Not all companies that serve interest-based ads participate in the ad industry opt-out programs described above, so even after opting-out, you may still receive some cookies and interest-based ads from other companies.
EMAILS
When you create an account, you may receive certain emails:
Transaction Emails: When you first create an account, we may send you a welcome email that provides information about your subscription and your account. If you make a purchase, we may send you an email confirming your purchase. We may also send you other emails concerning your account status and renewals. You may not opt out of transactional emails.
Marketing Emails: Depending on your preferences, we may send you emails letting you know about new programs or features, or promotions. You may opt out of these emails at any time in your account settings.
YOUR PRIVACY RIGHTS
You may change your account information or close your account at any time by logging into your account and adjusting your account settings. If you close your account or request that we delete your account, you may lose access to content you have purchased. When you close your account, we may preserve your account information to (i) let you know about new offers and content; (ii) restore your account, if you ever wish to re-subscribe; and (iii) where we believe in good faith that preservation is necessary to enforce our rights.
EEA Users:
Users from the European Economic Area (EEA) have the right to: opt out of cookies (see our Cookie Policy); access, correct, delete, restrict or object to our use of your personal information. If you would like to exercise any of these rights, please submit your request by using our form.
We process personal information to fulfill contracts with you and to provide services you have requested (for example, to fulfil a purchase), or otherwise to pursue our legitimate business interests. Note that your information will be transferred outside of Europe, including to the United States.
California Users:

To exercise your right to access or delete your personal information, submit your request by using our form. Note that to process your request, we must be able to verify your identity as the owner of the account you are inquiring about. We may not be able to fulfill your request until we can do so. Although you do not need to have an account to submit a request, we may not be able to locate certain information to process your request if you don’t have one.
Nevada Users:
Nevada residents have the right to opt out of the sale of certain “covered information” collected by operators of websites or online services. We currently do not sell covered information, as “sale” is defined by such law, and we don’t have plans to sell this information.
CHILDREN’S PRIVACY
The Service is not intended for individuals under the age of 16. If you are a parent or legal guardian who has discovered that your child has provided personal information through the Service without your consent, please contact us so that we can remove any unauthorized information.
CHANGES
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. Your continued use of the Service constitutes your agreement to any updated Privacy Policy on a prospective basis.

Viewer Terms of Service Agreement – Darbar Player

This Darbar Player Viewer Terms of Service Agreement (“Agreement”) is between you and Darbar Arts Culture and Heritage Trust (“Darbar,” “we,” or “us”). This Agreement governs your use of the “Darbar Player,” an online platform that allows viewers to stream Indian classical music performances from content owners and licensors (“Producers”) through the Darbar-branded website and applications.
Notice: Section 10 of this Agreement contains a mandatory ARBITRATION AGREEMENT. By using Darbar Player, you agree that any claims you may have against Darbar relating to Darbar Player must be ARBITRATED, and you waive the right to (1) assert claims against Darbar in court; (2) participate in a class action; and (3) have a jury hear your case.
- Acceptance
By creating an account, viewing videos, making a purchase, or otherwise using Darbar Player, you accept this Agreement and consent to contract with us electronically.
If you represent an entity, you warrant that you have the authority to bind that entity to this Agreement. In such a case, “you” refers to both the entity and each person who is authorised to access the account.
We may update this Agreement by posting a revised version on our website. Your continued use of Darbar Player constitutes acceptance of any revised Agreement.
You may terminate the Agreement at any time by deleting your account. We reserve the right to suspend or terminate your account for breach of these terms. If Darbar deletes your account for breach, you may not re-register. The following sections will survive termination: Section 7 (Disclaimers), Section 8 (Limitation of Liability), Section 9 (Indemnification), Section 10 (Arbitration Agreement; Jury Waiver; Class Action Waiver), and Section 11 (General Provisions).
- Accounts
- Registration: You must create an account to use certain features of the Service (e.g., to view a Programme). By creating an account, you agree to receive notices from Darbar and the Producers of the Programmes you purchase.
- Age Requirements: You may not create an account if you are under 18 years of age. By creating an account, you represent that you meet this age requirement.
- Account Security: You are responsible for all activities under your account, including unauthorised activity. Safeguard your account credentials, and if using a shared device, ensure you log out after each session. If you become aware of unauthorised access to your account, change your password and notify us immediately.
- Privacy
Please review our Privacy Policy to learn about the information we collect, how we use it, and with whom we share it. By creating an account, you agree that the Producer of the Programme(s) you purchase will have access to your account information, including viewing and purchase history.
- Programme Viewing and Purchase Options
Darbar Player offers several viewing options:
- Rental: Stream a Programme an unlimited number of times during the rental period.
- Purchase: Stream a Programme an unlimited number of times, and, if offered, download the Programme.
- Subscription: For a recurring fee of £99 per year or £9.99 per month, you may stream any Programme offered within Darbar Player’s subscription channel an unlimited number of times during your subscription period. Programmes may be added or removed at any time.
To make a purchase, you must provide a valid payment method. All purchases, including recurring charges, are final and non-refundable.
- Darbar Festival Discount Code
New subscribers who have attended the Darbar Festival are eligible for a special one-off Darbar Festival discount code, reducing the first annual subscription fee to £39.99 (standard price: £99). This discount is available only to new subscribers, and cannot be combined with other offers. Darbar reserves the right to modify or withdraw this discount at any time.
- Licences and Intellectual Property
- Licence to Programmes: You may stream or download (if available) Programmes for personal, non-commercial use during the rental or subscription period.
- Restrictions: You may not resell, publicly perform, or create derivative works from any Programme. All rights not expressly granted are reserved by the Producer.
- Acceptable Use Policy
By using Darbar Player, you agree to refrain from activities that:
- Infringe copyrights or other rights.
- Are defamatory, harassing, or abusive.
- Violate any laws.
- Disclaimers
Darbar Player is provided “as is” and “as available.” Darbar disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability
To the maximum extent permitted by law, Darbar shall not be liable for indirect, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, or other intangible losses.
- Arbitration Agreement; Jury Waiver; Class Action Waiver
All claims related to the use of Darbar Player shall be resolved by binding arbitration, and you waive the right to a trial by jury and to participate in a class action.
- General Provisions
- Choice of Law: This Agreement shall be governed by the laws of England and Wales.
- Severability: If any term of this Agreement is deemed invalid or unenforceable, the remaining terms shall remain in effect.
This Agreement represents the entire understanding between you and Darbar regarding the use of Darbar Player.
